Jubilee Insurance Sued by Cofek for Failing to Honor a Claim

Jubilee Allianz Insurance is being sued by the Consumers Federation of Kenya (Cofek) for failing to honor a motor vehicle claim.

According to Cofek, the insurer did not offer a solid legal justification for rejecting the premium. Cofek said that once the insurer refused to assist, it had told its attorneys to sue the insurer.

“We hope you are aware of the provisions of Section 7 of the Consumer Protection Act, 2012 on ambiguities and why any Court would rule in favor of the consumer (the insured),”

“Again, Article 46(1)(b) requires full and proper information.  We hope you can respond to the above questions within 24 hours, ”Cofek added in a statement.

The insurer claims that they received a claim for an incident that occurred on January 7, 2022.

The insured was protected by the automobile private policy against accidental losses as well as damage to the vehicle, its accessories, or spare components.

According to the insured, the covered driver was traveling alone to his rural house in Kaptagat at approximately 2130 hours along Eldama Ravine-Eldoret Road.

He encountered an unknown approaching car as he got to Kamwosor region, where the road was being constructed, and it encroached into his legal lane while avoiding hitting a pothole.

The insured driver attempted to avoid a collision by swerving to the left side of the road, but he or she lost control of the car and it veered off the road before coming to rest in a ditch.

The car sustained damage to the sump guard underneath, had a dented front bumper, oil leaks, a shattered windscreen, and airbags that activated. No harm was done to the driver.

Police officers arrived at the scene when the insured driver reported the incident to the Kaptagat police station.

A motor assessor’s evaluation put the cost of bringing the car back to its pre-accident state at Sh469626, although also raised questions about the consistency of the damage.
